Terms of service
General Terms
For me to accept your commission request after you've submitted it, I will reach out to you letting you know I've accepted your request and send you a Commission Request Agreement outlying my commissions process including but not limited to: $60 or $100 deposit fee, initial consultation with initial sketch, mock-ups/drafts; 25%, 50%, and final completion check ins, and payment options.
DO NOT SEND A PAYMENT until I have sent a electronically signed Commission Request Agreement with an invoice detailing itemization of services asked for the commission.
I "stamp" my signature on all artwork and will do so on commissioned pieces, unless otherwise requested not to do so because it affects the integrity/aesthetic of the commissioned piece. If this is the case, I will alter my signature to not disrupt the aesthetic of the work.
I might use the commissioned piece for self promoting via social media, unless asked not to do so.
I hold the right to reject your commission request if I don't think I'm the best for your vision.
Payment
Payment Details and Options
I accept payments via Square and ask for a $60 deposit for commissions estimated to be completed in under 3 hours and $100 deposit to start commissions that will take longer than 3 hours. The $100 deposit will be subtracted from the final payment price once commission is ready for commission taking longer than 3 hours to complete.
Payment Plan
I offer a payment plan of two installments for commissions estimated to take longer than 3 hours to complete. First payment installment will be 50% of ($40 x (estimated time spent on artwork) and any additional request fees) - $100 deposit.
Example:
For a digital commission estimated with an 11hr completion time: $40 x 11hrs= ($440-$100 deposit) x .5= $170 for the 1st installment payment.
For a printed commission sized 16x20, 5 hrs completion time, and custom paint for framing: (($40 x 5)+$15+$10)-$100 deposit)x.5= $62.50 for the 1st installment payment.
Refunds/Cancellations
Commissions that are estimated to be completed in under 3 hours are not eligible for a refund.
For commissions estimated to be completed in over 3 hours:
If you have to cancel the commission process at anytime before the final check in, I will issue you a refund amount of payment made up until that point, but I will retain the $100 deposit for services already rendered.
Personal vs Commercial Commissions
Personal Commissions
If you request a personal commission from me, the following circumstances are implied, unless otherwise stated in the Commissions Request Agreement:
As I, the artist (Kendra Lee, dba Blackfruit)
I retain all copyrights over the commissioned artwork.
I will NOT claim intellectual property of the commissioned artwork.
I retain the right to use your commission for promotional purposes on my social media, unless otherwise stated in the Commission Request Agreement.
I will not use your commissioned artwork intended to gain profit outside the scope of what’s stated in the Commission Request Agreement.
As you (the commissioner of artwork)
You cannot use the commissioned artwork for commercial use if you have not indicated that is your intent of the commissioned artwork on the Commission Request Form and Agreement. This includes but not limited to: uploading to print on demand storefronts; reselling; selling digital downloads, social media use to gain profit, etc.)
You cannot alter the final version of the commissioned artwork in anyway not outlined and stated in the Commission Request Agreement.
You retain the rights to the intellectual property of the commissioned artwork.
You may have your commissioned artwork printed out, outside my service as long as it is not intended to gain profit and only for personal use..
Commercial Commissions
If you request a commercial commission from me, the following circumstances are implied, unless otherwise stated in the Commissions Request Agreement:
As I, the artist, (Kendra Lee, dba Blackfruit,
I give up the right to use the commissioned artwork outside the scope of what’s agreed between myself, as the artist, Kendra Lee, dba Blackfruit, and you, the commissioner of the artwork, as stated in the Commission Request Agreement.
I give up copyrights of the commissioned artwork outright, but retain credit as having created the commissioned artwork.
As you, the commissioner of the artwork,
You have the right to use the commissioned artwork, in anyway you see fit.
You earn full ownership of the commissioned artwork once final payment has been made.
Process and Delivery of Commission
Commission Process
You fill out and submit the Commissions Request Form.
I receive the request, review and determine if your request is a good fit for my expertise and style.
I notify you whether or not I accept the commission request .
If I accept your request, I will send you a sketch based on what you typed on the Commission Request Form, along with an invoice for a deposit of either $60 or $100 depending on the estimated time of completion of the commission. I will also schedule a time to consult with you about your vision and how to further bring it to life.
After consultation, I will send you a timeline of services to be fulfilled and payment installment due dates if necessary.
Check In's:
1st check in, I will send several mock-ups/sketches for approval to continue commission. First payment installment will be due after 1st check in.
2nd check in, I will send updates on commission progress, any revisions are considered at this point.
3rd check in (final), I will send digital version of commission work for final approval.
After final check in and your final approval for the commission, I will send you an invoice for the remaining balance, itemizing all services rendered and their prices.
After you have paid in full, I will send/or deliver the version of the commission you requested (digital file or printed version.)
What You Get
Throughout the commissions process you will receive some if not all of the following:
Initial sketches/mockups/drafts (watermarked) that you will have input and need to approve before I continue the commission.
A sketch/final version you must before final rendering and preparation for delivery.
A full resolution final version at 300pi and/or smaller version for internet upload. Final format of your choosing (png, jpeg, tiff, pdf, animated files).
For commerical commissions:
A final version with the original psd files.
